Intellectual Property

All elements of the website www.lumans.co — structure, design, texts, photographs, illustrations, logo, the brand name Lumansand the artworks offered for sale — are the exclusive property of Empo Global Services, LLC and their respective authors. They are protected by applicable intellectual property laws in the United States (U.S. Copyright Act, Lanham Act) and internationally under conventions to which the United States is a party (including the Berne Convention).

Any reproduction, representation, modification, publication, adaptation, or exploitation — in whole or in part — of any element of the website, without the prior written authorisation of Empo Global Services, LLC, is strictly prohibited.

Art. 4 Limitation of Liability 

Empo Global Services, LLC endeavours to ensure the accuracy of the information published on the website, without being able to guarantee its completeness or permanent currency. The company shall not be held liable for direct or indirect damages resulting from access to or use of the website, service interruptions, or the presence of links to third-party websites whose content it does not control.

Art. 5 Scope & Acceptance

These General Terms and Conditions of Sale ("GTC") govern all commercial relationships between Empo Global Services, LLC, trading under the brand name Lumans (hereinafter "Lumans" or "the Seller"), a company incorporated under US law, and any non-professional buyer (hereinafter "the Customer") making a purchase through the website www.lumans.co.

Any order placed on the website constitutes full, unconditional acceptance of these GTC as in force at the time of validation. The Seller reserves the right to modify them at any time, without retroactive effect on orders already confirmed.

The Customer declares that they are of legal age under the legislation of their country of residence and have the legal capacity to enter into contracts.

Art. 6 Products

Lumans sells the following categories of products:

• Silk scarves — artisanal textile pieces in natural silk
• Original artworks — paintings, prints, and other unique or limited-edition creations

The essential characteristics of each product are described on the corresponding product page. Visuals are as faithful to reality as possible; however, slight variations in colour and dimensions may exist between the on-screen rendering and the physical product, particularly for textiles and artworks, and shall not be contractually binding on the Seller.

Offers are valid subject to available stock. In the event of unavailability following order confirmation, the Seller will inform the Customer as soon as possible and offer either a full refund or an equivalent substitute product.

Art. 7 Prices & Taxation

Prices displayed on the website are expressed in euros (€) et en dollars américains (USD)Delivery costs are indicated separately and clearly displayed before final order confirmation.

Products are invoiced at the price in force at the time the order is recorded. Lumans reserves the right to modify its prices at any time; changes do not apply to orders already confirmed.

Art. 8 Payment

Payment is made in full at the time of order confirmation. Accepted payment methods are:

Transactions are secured by SSL/TLS encryption. Empo Global Services, LLC does not store any banking data; payment processing is handled by certified third-party providers.

Art. 9 Shipping

Lumans delivers worldwide. To ensure secure delivery, all shipments are made against signature.

The choice of carrier is made by Lumans based on the destination and nature of the product. Orders are dispatched in a single shipment, unless an item is unavailable.

Timeframes run from the dispatch confirmation (sending of the tracking number). They are indicative and may be affected by circumstances beyond the Seller's control (customs delays, weather conditions, strikes, etc.).

Upon receipt of the parcel, the Customer must check the condition of the package and its contents. Any anomaly (damaged parcel, missing product) must be reported to the carrier at the time of delivery and notified to Lumans by email at contact@lumans.co within 14 days of delivery, accompanied by photographs. After this period, no claim will be accepted.

Art. 10 Right of Withdrawal

Lumans grants its customers a right of withdrawal of 14 calendar days from receipt of the products, without obligation to provide a reason.

To exercise this right, the Customer must notify their decision before the expiry of the 14-day period by sending a clear email to contact@lumans.co stating their order number, or by using the form below.

Art. 11 — Returns & Refunds

Following valid exercise of the right of withdrawal, the Customer has fourteen (14) days from the delivery to return the products at their own expense.

Products must be returned in their original condition, complete, unused, unwashed, and in their original packaging. Any product returned incomplete, damaged, used, or without its original packaging will be refused or subject to a reduction in value, at the Seller's sole discretion.

Refund conditions: The refund will be processed within fourteen (14) days Upon receipt of the returned product in good condition in its original packaging with all accompanying items. The refund will be issued via the same payment method used for the order. Shipping costs are non-refundable, except for orders delivered within the EU and placed using standard shipping. Return shipping costs are the responsibility of the Customer. 

Warranties

Lumans warrants that the products sold conform to their description and are free from manufacturing defects at the time of delivery.

In the event of a defective or non-conforming product, the Customer has fourteen (14) days  from receipt to inform the Seller by email at contact@lumans.co, with supporting photographs. The Seller will then offer, at its discretion, a replacement product, a store credit, or a full refund.

Art. 13 Limitation of Liability

To the fullest extent permitted by applicable law, the liability of Empo Global Services, LLC in respect of an order is strictly limited to the total amount paid by the Customer for that order.

The Seller shall not be held liable for:

• Indirect damages, loss of profits, intangible or consequential losses
• Delivery delays attributable to carriers or customs procedures
• Taxes, duties, or import charges imposed by the destination country
• Any loss or damage resulting from improper use of the products
• Errors or omissions in information provided by the Customer when placing an order

This limitation does not apply in cases of personal injury, fraud, wilful misconduct, or any other liability that cannot be legally limited.

Art. 14 Force majeure

Lumans shall not be held liable for total or partial failure to fulfil its obligations in the event of a force majeure event, defined as any unforeseeable, irresistible event beyond the control of the parties, including without limitation: natural disasters, pandemics, fires, postal or transport strikes, governmental acts, wars, failures of communication networks or computer systems.

In the event of force majeure, the Seller will inform the Customer as soon as possible.

Art. 15 Customer service

All complaints must be addressed in the first instance to customer service. Lumans is committed to handling each request with diligence and good faith.

Art. 16 Governing Law & Dispute Resolution

These GTC are governed by and construed in accordance with the law of theState of Maryland, United States, without regard to its conflict of law rules.

In the event of a dispute, the parties agree to seek an amicable resolution in the first instance by contacting customer service at contact@lumans.co.

Failing amicable resolution within 30 days, any dispute shall be submitted to the exclusive jurisdiction of the courts of the State of Maryland, United States, unless mandatory legal provisions applicable in the Customer's country of residence provide otherwise.

Art. 17 Miscellaneous Provisions

Entire agreement: These GTC constitute the entire agreement between the parties with respect to their subject matter and supersede all prior agreements, commitments, or communications.

Severability: If any provision of these GTC is declared null, unlawful, or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.

Non-waiver: The fact that Lumans does not invoke a provision of these GTC at any given time shall not constitute a waiver of the right to invoke it at a later date.

Language: These GTC are drafted in French. In the event of translation, the French version shall prevail in case of contradiction.

Personal data: The processing of personal data collected in the context of orders is governed by the Lumans Privacy Policy, available on the website.
